Terms of Service

Effective Date: December 9, 2025

1. Acceptance of Terms

By creating an account or using any of the Chaos Constellation applications (Focus, Resonate, Capture, Growth, and any related websites or services, collectively the "Services"), you agree to these Terms of Service ("Terms"), our Privacy Policy, and Apple's App Store Review Guidelines (incorporated by reference for iOS apps).

2. Description of Service

Chaos Constellation LLC ("we," "us," or "our"), a Texas limited liability company, provides web and mobile applications for productivity (task management, note-taking, etc.) and social networking features (posting, sharing, voting, commenting, following, etc.). All apps use a single unified login.

3. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Services. If you are under 18, you represent that you have your parent or guardian's permission. For creator or user-generated content exceeding the app's age rating, we use verified or declared age mechanisms to restrict access.

4. Account Registration

  • You will create one account that works across all Chaos Constellation apps.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
  • You agree to provide accurate, current, and complete information and to keep it updated.
  • Account Deletion: You may initiate deletion of your account (and associated data) at any time via the in-app settings menu. Deletion will be processed within 30 days (or sooner where possible), except for data we are required by law to retain. We will confirm completion via email. Partial deletions (e.g., specific data types) may be available where feasible.

5. User Content

You retain ownership of content you post ("User Content"). By posting, you grant Chaos Constellation LLC a worldwide, non-exclusive, royalty-free, transferable license to use, store, display, reproduce, modify, and distribute your User Content solely to operate, improve, and provide the Services.

We may use User Content to train AI models only with your explicit consent (e.g., via opt-in settings). You represent that your User Content does not violate these Terms or any laws.

6. Prohibited Conduct

You agree not to:

  • Post illegal, harmful, abusive, defamatory, obscene, hateful, or NSFW content (e.g., pornography, threats, bullying)
  • Harass, threaten, or impersonate other users or entities
  • Upload viruses, malicious code, or spam
  • Scrape, spider, or automate access to the Services
  • Violate any applicable law, third-party rights, or Apple's App Store Review Guidelines (e.g., Guideline 1.2 on objectionable content)

We employ automated filtering, user reporting, and human moderation to enforce this. Violations may result in content removal, account suspension/termination, and reporting to authorities.

7. User-Generated Content Moderation (for Social Features)

For apps with sharing/voting (Resonate, Capture, Growth):

  • All posts are scanned via automated tools for objectionable material before visibility.
  • Users can easily report abusive content via in-app flags; we review and respond within 24-48 hours.
  • Blocking: Users can block others, hiding their content from view.
  • We prohibit unmoderated mature content; age-gated sections require verification.

Failure to comply with moderation may lead to app rejection/removal by Apple.

8. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason with or without notice. Upon termination, you must cease using the Services.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHAOS CONSTELLATION LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (OR $50 IF YOU PAID NOTHING).

11. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Exclusive venue for any dispute is Travis County, Texas.

12. Changes to Terms

We may update these Terms. We will notify you of material changes via the app or email. Continued use after changes constitutes acceptance.
